After judgement is dismissed, Does collection agency have to take off my credit report?

I recieved papers for small claims from a collection agency that has a bill from an old credit card I had 5 or 6 years ago. Anyway, I sent them a certified letter asking for all the documentation that I owed this debt, all original information and contracts signed etc... Then I get notice that they sent request for dismissal to small claims court. So will this get taken off my credit record (Its on there with the collection agency) I do have the papers that state it is dismissed.

The court case was dismissed. You shouldn%26#039;t have a judgment on your report. However, the debt in collections should still be there. Just because the creditor cancelled the court date, doesn%26#039;t mean the debt goes away.



Since they failed to validate the debt as you requested in your letter, send a dispute to the credit bureau with a copy of your letter, indicating the creditor failed to validate the debt. That should get it removed.

They *should* report this to the credit agencies, but they may not.



If they do not, you can do it yourself by disputing the item on your credit report. Each bureau has a procedure for you to follow, but basically you will send them your documentation.

They%26#039;re supposed to take it off your credit report, however often times they dont. All you have to do is contact all 3 major credit bureaus, Experian, Equifax and TransUnion and dispute it with them. The credit bureaus will remove it. Just let them know in writing that the debt has been dismissed and to please remove it.

The credit agencies probably do their best but things slip by. Check each one. If there is a problem, initiate a discussion by phone or mail. That should handle the situation.

Once the the judgement has been dismissed, it must be removed from your credit report. You should check your credit report with all three agents to make certain it has been removed. When requesting your credit report, get a single report from all three agents not one consolidated report. Your consolidated report does not show if there are any duplications between all three reports which is pretty common.

By law they have 30 days from the time they receive the validation letter (you did send it certified return receipt I assume) to validate the debt or it must be removed from your credit report. If they do not remove the listing, it is a violation of the Fair Debt Collection Practice Act and you have a very easy lawsuit for $1000 provided you followed all the steps.



Note that this applies to the actual delinquency item on your report. A Judgement was never won and that should have never been on your report.
